By accessing this website, purchasing any product or service, submitting vehicle information, receiving tune files, or engaging in ECU tuning services from PowerHouse Tuning Inc., you acknowledge that you have read, understood, and agree to be legally bound by these Terms & Conditions.

If you do not agree, do not use this website or services.

1. Company Information

2. Definitions

“Company” refers to PowerHouse Tuning Inc.
“Customer” refers to any individual or entity purchasing or using services.
“Services” include ECU tuning, remote tuning, reflashing, calibration, tune files, revisions, and all related services.
“Products” include physical goods such as cables, interfaces, and hardware.

3. Assumption of Risk

You acknowledge that vehicle modification and ECU tuning involve significant risk, including but not limited to:

Engine failure
Transmission failure
Drivetrain or differential failure
Turbocharger or supercharger failure
Fuel system failure
ECU or TCU corruption
Electrical system failure
Reduced reliability or drivability
Vehicle breakdown or loss of use
Fire, property damage, or personal injury

You voluntarily assume all risks associated with vehicle modification, tuning, flashing, and operation of modified vehicles.

4. Off-Road / Motorsport Use Only

Unless otherwise stated in writing, all services and products are intended for off-road or motorsport use only.

You are solely responsible for ensuring compliance with all applicable laws, including emissions, safety, inspection, and road legality requirements.

5. Customer Responsibility

You are solely responsible for:

Providing accurate and complete vehicle and modification information
Ensuring proper installation of all parts
Ensuring vehicle mechanical condition and maintenance
Fuel quality and octane rating
Disclosing all relevant modifications and issues
Ensuring supporting systems (sensors, wiring, fuel system) are functioning properly

PowerHouse Tuning Inc. is not responsible for damage caused by inaccurate information, hidden mechanical issues, poor maintenance, improper installation, or third-party work.

6. Remote Tuning & Flashing Risks

You acknowledge that remote tuning and ECU flashing carry risks including ECU/TCU failure or corruption.

PowerHouse Tuning Inc. is not responsible for:

ECU or TCU failure or “bricking”
Interrupted flashing processes
Power loss during flashing
Laptop, cable, or software failure
Internet or communication issues
User error or incorrect procedure
Vehicle starting or running issues caused by interruption

7. No Performance Guarantees

PowerHouse Tuning Inc. does not guarantee:

Horsepower or torque gains
Fuel economy improvements
Drivability or smoothness
Reliability or component lifespan
Emissions compliance
Specific performance outcomes

Results vary depending on vehicle condition, fuel quality, modifications, and environmental factors.

8. Intellectual Property

All tune files, maps, calibrations, and tuning strategies remain the exclusive property of PowerHouse Tuning Inc.

You may not copy, share, resell, distribute, or reverse engineer any tune file or calibration.

9. Licensing

UpRev and EcuTek licenses are non-refundable once assigned or activated under any circumstances.

10. Limitation of Liability

To the fullest extent permitted by law, PowerHouse Tuning Inc. shall not be liable for any damages including but not limited to:

Engine or drivetrain failure
Vehicle downtime
Loss of use or income
Repair or towing costs
Property damage
Personal injury or death
Indirect, incidental, or consequential damages

Total liability shall not exceed the amount paid for the specific service provided.

11. No Warranty

All services and products are provided “as is” without any warranties of any kind, express or implied.

12. Indemnification

You agree to indemnify and hold harmless PowerHouse Tuning Inc. from any claims, damages, losses, or legal fees arising from:

Vehicle use or modification
Misuse of services or tune files
Third-party claims
Legal violations
Chargebacks or disputes

13. Chargebacks & Disputes

You agree to contact PowerHouse Tuning Inc. at info@powerhousetuning.ca before initiating any chargeback or dispute.

Unresolved or fraudulent chargebacks may result in service termination and recovery of legal and collection costs.

14. Termination

PowerHouse Tuning Inc. reserves the right to refuse service or terminate access at any time without notice.

15. Governing Law

These Terms are governed by the laws of the Province of Ontario, Canada. Any disputes shall be handled exclusively in Ontario courts.

16. Changes to Terms

We reserve the right to update these Terms at any time without notice. Continued use of services constitutes acceptance of the updated Terms.
